These Terms of Use and End User License Agreement (“Terms” or “EULA”) govern your use of the When Do I Expire mobile application and related services (the “App”) provided by When Do I Expire (“we,” “our,” or “us”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Description of Service

When Do I Expire is an application that helps you track certification and license expiration dates across multiple professions. The App allows you to store certifications, attach documents and photos, set reminders, and view renewal history. Some features may require a paid subscription. We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice where practicable.

2. Eligibility and Account

You must be at least 13 years of age (or the minimum age in your jurisdiction) and capable of forming a binding contract to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us promptly of any unauthorized use. We are not liable for losses arising from unauthorized use of your account.

3. Subscription, Payment, and Refunds

Subscription. Access to premium features may require a paid subscription (e.g., $9.99 per month or $79.99 per year, or other pricing we publish). You may track up to 2 certifications for free. By subscribing, you agree to pay the applicable fees for the subscription period you select.

Billing. Subscriptions are billed through the Apple App Store or Google Play Store, depending on where you downloaded the App. Payment will be charged to your Apple ID or Google Play account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price. You can manage subscriptions and turn off auto-renewal in your Apple ID Account Settings or Google Play subscription settings after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Refunds. Refund requests for subscriptions or in-app purchases are handled by Apple or Google in accordance with their respective policies. We do not process refunds directly; please see our Refund Policy for how to request a refund, or contact Apple or Google support for billing and refund questions.

Price changes. We may change subscription prices with reasonable notice. Price changes will apply to new subscriptions and to renewals after the effective date of the change, where permitted by the applicable store and law.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:

Violate any applicable law or regulation;
Infringe the intellectual property or other rights of others;
Upload content that is defamatory, obscene, or harmful;
Attempt to gain unauthorized access to the App, our systems, or other users’ accounts;
Use the App to distribute malware or interfere with the operation of the service;
Resell, sublicense, or commercially exploit the App except as expressly permitted; or
Use automated means (e.g., scraping, bots) without our prior written consent.

We may suspend or terminate your access if we reasonably believe you have violated these Terms or for any other reason with notice where required by law.

5. Your Content and Our Rights

You retain ownership of the content you upload (e.g., certifications, documents, photos). By uploading content, you grant us a limited license to store, process, and display that content as necessary to provide and improve the App. We do not claim ownership of your content. The App, including its design, features, and our trademarks and branding, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, or create derivative works of the App or our branding without our written permission.

6. Disclaimer of Warranties

THE APP AND RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOU USE THE APP AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES; IN SUCH CASES, THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

The App is intended to help you track certification dates; it is not a substitute for professional advice or official records. You are responsible for verifying the accuracy of your certifications and renewal deadlines.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR $50 USD IF GREATER). SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR LIABILITY; IN SUCH CASES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

8. Indemnification

You agree to indemnify, defend, and hold harmless When Do I Expire and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the App, your content, your violation of these Terms, or your violation of any third-party rights.

9. Third-Party Terms

Your use of the App may also be subject to the terms and policies of Apple (for iOS) or Google (for Android), including the App Store Terms and Conditions and Google Play Terms of Service. In the event of a conflict between those terms and these Terms with respect to the App itself, these Terms shall govern to the extent of the conflict; the applicable store terms shall govern with respect to your relationship with Apple or Google (e.g., payment, refunds).

10. Changes to the Terms

We may update these Terms from time to time. We will post the updated Terms in the App and on our website and update the “Last updated” date. For material changes, we may provide additional notice (e.g., in the App or by email). Your continued use of the App after the effective date of the changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the App and may cancel your subscription through the applicable store.

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which When Do I Expire operates, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in that state, and you consent to the personal jurisdiction of such courts. Nothing in these Terms shall limit your right to seek relief in a small claims court where applicable.

12. General

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in effect. Our failure to enforce any right or provision shall not constitute a waiver. These Terms constitute the entire agreement between you and us regarding the App and supersede any prior agreements. We may assign these Terms; you may not assign without our prior written consent.
